During civil discovery in San Francisco, Walsh's document production included photographs of dozens of pregnancy tests. The quantity was unusual—far exceeding what normal pregnancy confirmation would require.

The nanny, Abrehet Tedla, stated in sworn testimony that she witnessed Walsh purchase novelty pregnancy tests—tests designed to display a positive result regardless of the user's actual pregnancy status.

A text message from Walsh, produced in the same discovery, states: "I think he knows I am not ACTUALLY pregnant." The capitalization of "ACTUALLY" is Walsh's original emphasis. The statement acknowledges that the pregnancy being represented to Russell was fabricated or that its authenticity was being questioned, and that Walsh was aware of this.

The evidence was presented in court and subjected to cross-examination in October 2019.
